Welcome to Jaguar Landscape (“Company,” “we,” “us,” or “our”). By accessing our website, requesting an estimate, signing a proposal, or engaging our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use our website or services.
1. Services
Jaguar Landscape provides professional landscaping and outdoor construction services in the State of Texas, including but not limited to:
- Sod and turf installation
- Landscape design and installation
- Pool-adjacent gardens and turf
- Hardscape construction
- Fencing installation
- Property enhancements and related outdoor services
All services are subject to site conditions, material availability, weather, and acceptance of a written proposal or contract.
2. Estimates and Proposals
- All estimates are non-binding unless expressly stated in writing.
- Proposals are valid for 30 days unless otherwise specified.
- Pricing may change due to unforeseen site conditions, material price fluctuations, or scope changes.
- Any changes requested after approval may result in additional charges and schedule adjustments.
3. Payments and Deposits
- A deposit may be required before scheduling work.
- Payment terms will be outlined in your proposal or invoice.
- Final payment is due upon substantial completion unless otherwise stated in writing.
- Late payments may incur interest, collection costs, and/or suspension of future services.
4. Texas Mechanic’s & Materialman’s Lien Rights
In accordance with Texas Property Code Chapter 53, Jaguar Landscape reserves the right to file a Mechanic’s and Materialman’s Lien against the property for non-payment of labor, materials, or services provided.
Failure to pay in accordance with agreed terms may result in lien filings, legal action, and recovery of attorney’s fees and costs as permitted by Texas law.
5. Scheduling, Weather, and Delays
- Project timelines are estimates only.
- Weather conditions common in Texas (heat, drought, heavy rain, freezes) may delay installation or affect materials and plant health.
- Jaguar Landscape is not responsible for delays caused by weather, permitting, inspections, material shortages, or events beyond our control.
6. Client Responsibilities
You agree to:
- Provide accurate property boundaries and disclose underground utilities, irrigation lines, drainage systems, septic systems, or structural elements.
- Obtain HOA approvals or permits unless otherwise agreed in writing.
- Provide reasonable access to the job site.
- Secure pets and remove personal items from work areas.
Jaguar Landscape is not responsible for damage resulting from undisclosed conditions.
7. Plant, Sod, and Turf Disclaimer
- Due to Texas climate conditions, plant and sod survival cannot be guaranteed unless a written warranty is explicitly provided.
- Warranty coverage may be void if proper watering, drainage, soil preparation, or maintenance guidelines are not followed.
- We are not responsible for loss due to drought, freezes, excessive heat, pests, disease, soil conditions, or acts of nature.
8. Property Conditions and Damage
While reasonable care is taken, landscaping and construction work may cause temporary disturbances including soil compaction, irrigation disruption, or surface marks. Restoration beyond the agreed scope of work is not included unless stated in writing.
9. Limitation of Liability
To the fullest extent permitted by Texas law:
- Jaguar Landscape shall not be liable for indirect, incidental, special, or consequential damages.
- Total liability shall not exceed the amount paid for the specific service giving rise to the claim.
10. Website Use
- Website content is provided for general informational purposes only.
- You may not copy, reproduce, or distribute content without written consent.
- We make no warranties regarding website availability or accuracy.
11. Intellectual Property
All content on this website—including logos, images, designs, text, and branding—is the property of Jaguar Landscape and may not be used without prior written permission.
12. Termination of Services
We reserve the right to refuse or terminate services for:
- Non-payment
- Unsafe or hazardous site conditions
- Harassment or abuse of staff
- Breach of these Terms
Payment remains due for all work completed up to termination.
13. Governing Law and Venue
These Terms shall be governed by and interpreted in accordance with the laws of the State of Texas. Venue for any legal action shall lie exclusively in the county in which Jaguar Landscape is headquartered or where the project is located, at our discretion.
14. Changes to These Terms
We may update these Terms at any time. Continued use of our website or services constitutes acceptance of the revised Terms.
